The Delhi High Court on 21 April 2006
dismissed the petition filed by Reliance Airports Developer Private Ltd (an Anil
Ambani enterprise) challenging the award of contract for modernisation of the
Delhi and Mumbai airports. The Court judged that no mala fide or arbitrariness
were acted upon in awarding the bids to two private developers.
RADPL had challenged the award of the
Delhi modernisation project to the GMR consortium, stating that RADPL was the
highest financial bidder. It may be recalled that the GMR consortium was the
highest bidder on technical grounds and that it was given a chance to match the
financial bid of RADPL, which it subsequently did.
The Court however held that
GMR-Fraport was the only qualified tenderer on technical ground and rightly
bagged the tender for Delhi airport.
RADPL still has the option to move a
Special Leave Petition in the Supreme Court during the next two weeks (around 5
May 2006.)
